Proof of Claim
In November 2004, a proof of claim form along with the Notice of Bar Date was mailed to all of the Debtors' known creditors and other parties in interest. The Notice of Bar Dated advised that the Bankruptcy Court had set January 31, 2005 as the deadline for filing proofs of claim (the "General Bar Date").
The Notice of Bar Date also advised that if you had a claim relating to the rejection of an executory contract or unexpired lease by either of the Debtors pursuant to an order entered prior to the confirmation of the plan of reorganization, you were be required to file a proof of claim on or before the later of (i) the General Bar Date; or (ii) thirty (30) days after the date of the order authorizing the applicable Debtor's rejection of the applicable contract or lease.
Any person or entity that failed or fails to file a proof of claim by the applicable Bar Date described above may be forever barred, estopped and enjoined from (i) asserting any General Claim against the applicable Debtor in an amount that exceeds the amount, if any, that is identified in that Debtor's Schedules on behalf of that person or entity as undisputed, noncontingent, and unliquidated; or (b) voting upon, or receiving distributions under, any plan of reorganization in the Debtors' chapter 11 cases in respect of such General Claim, notwithstanding that such person or entity may later discover facts in addition to, or different from those with that person or entity knows or believes to be true as of the applicable Bar Date, and without regard to the subsequent discovery or existence of such difference to additional facts.
